前回の記事では短期商用ビザについてご説明させていただきましたので今回は短期滞在の「知人・親族訪問」ビザについてご説明させていただきます。

短期滞在ビザは日本での滞在期間が3ヵ月未満である場合に申請することが多い在留資格であり、主に「観光」・「商用」・「知人・親族訪問」目的での活動に該当する場合に申請が許可されます。

この短期滞在ビザ（知人・親族訪問）では例えば、

■婚約者を結婚の手続き等で日本に連れてきたい。

■交際相手を自分の親に紹介したい。

■短期間日本の恋人と同棲生活がしたい。

■親族が病気であるためそのお世話をしに日本に呼びたい。

■外国人のパートナーが妊娠したことに伴い、産前産後のケアに外国に住む親族を呼びたい。

■日本人の友人に会いにいきたい。

上記のような事例で日本に招へいすることが挙げられます。

許可される日数としては、15日、30日、60日、90日があります。

短期滞在ビザでは「招へい人」と「身元保証人」を設定することが必要になります。

「招へい人」は読んで字のごとく、日本に外国人を呼ぶ方という意味です。

「身元保証人」は主に招へいされた外国人の金銭的な面倒を見るという認識になります。

身元保証人には法的な責任がなく、もしも招へいした外国人が借金をしたとしても身元保証人に取立や催促を受けることはありません。身元保証人に求められる責任はあくまで道徳上の責任にとどまるものとされます。（道義的責任）

尚、この「招へい人」と「身元保証人」は各種の事情を考慮し、招へいする外国人を十分に保証する能力があると認められれば兼任することが可能です。

この「招へい人」と「身元保証人」が呼び寄せるかたちでビザを取得すれば、自宅や実家、ホテルや旅館などに滞在しながら全国各地の観光スポットを自由に訪問することが可能となります。

国によっては日本との協定によりビザ免除国となっていますので当所にご連絡いただければ日本に招へいしたい方の国が、日本との間でビザ免除国となっているかお調べ致します。

また、短期滞在ビザ共通になりますが短期滞在ビザで滞在する外国籍の方は日本で収入を伴う活動を行うことができません。

その為、日本で正社員はもちろんのことアルバイトをすることによって収入を得ること認められておりませんのでご注意ください。

現在（2022年9月8日）、日本は入国制限を行っており、就労等で来日する際にはERFS申請をし、受付済証の発行を受ける必要がありますが、この知人・親族訪問ビザではERFS申請を行う必要がありません。

しかし、どのような知人・親族訪問でも認められるというわけではなく、知人を招へいする場合には以下のような制限があります。

■本邦居住者と親族に準ずる以下の関係にある者
・婚約者
・事実婚関係
・訪日の必要性があると認められる者
・結婚式又は葬儀に参列する者
・病気の知人を訪問する者

上記のほか、特に人道上配慮すべき事情があるときや、公益性があるときといった、個別の事情が認められるものについて短期滞在ビザ（知人・親族訪問）が許可されます。

短期滞在ビザ（知人・親族訪問）で必要になる書類は国によって異なる場合がありますが主に日本側で用意する書類は下記の通りとなります。

■招へい理由書

■滞在予定表

■親族関係を証明する資料：戸籍謄本や出生証明書など

■身元保証書

■身元保証人に関わる次の書類のいずれか１点

・所得証明書　

・預金残高証明書　

・確定申告書控　

・納税証明書

■住民票

■戸籍謄本（婚姻済みの場合）

In this article, I would like to explain about "Visiting Acquaintances or Relatives" visa for a short stay in Japan.

A Temporary Visitor visa is often applied for when the period of stay in Japan is less than 3 months and the activity is mainly for "sightseeing", "business", or "visiting acquaintances/relatives".

For example, the following are the types of activities that are permitted under the Temporary Visitor Visa (Visiting Acquaintances or Relatives)
I would like to bring my fiancé(e) to Japan for marriage procedures, etc.
I would like to introduce my dating partner to my parents.
I want to live together with my Japanese lover for a short period of time.
I would like to invite my relative to Japan to take care of him/her because he/she is ill.
My foreign partner is pregnant and I would like to invite my relative who lives in a foreign country to Japan for prenatal and postnatal care.
I would like to visit a Japanese friend.

In the above cases, we would like to invite them to Japan. The above cases are examples of invitations to Japan.
The number of days allowed are 15, 30, 60, and 90 days.

A short-stay visa requires the establishment of an "inviting person" and a "guarantor. The "inviter" is the person who invites the foreigner to Japan.

The "guarantor" is mainly responsible for taking care of the financial affairs of the invited foreigner. The guarantor has no legal responsibility, and if the foreigner owes money to the guarantor, the guarantor is not subject to collection or demand. The responsibility of the guarantor is limited to moral responsibility (moral responsibility). (Moral Responsibility)

The "inviting person" and the "guarantor" can serve concurrently if the inviting person is recognized to have the ability to adequately guarantee the foreigner in consideration of various circumstances.
If the "inviter" and "guarantor" obtain a visa in the form of an invitation, the foreigner can freely visit tourist spots throughout Japan while staying at his/her home, family home, hotel, inn, etc. Some countries have agreements with Japan to exempt foreign nationals from visa requirements.

Some countries have visa waiver agreements with Japan, so please contact us and we will check if the country you wish to invite to Japan is a visa waiver country with Japan.

In addition, foreign nationals staying in Japan on a temporary visitor visa are not allowed to engage in any income-generating activities in Japan.
Therefore, please note that it is not permitted for foreign nationals staying in Japan on a temporary visitor visa to work part-time or earn income in Japan.

Currently (September 8, 2022), Japan is restricting entry into the country, and when coming to Japan to work, etc., it is necessary to apply for an ERFS and receive a Certificate of Acceptance. However, the following restrictions apply when inviting an acquaintance.

Persons who have the following relationships with a Japanese resident that are equivalent to those of a relative
A person who is engaged to a person who is not a relative of the applicant.
Those who are deemed to have a need to visit Japan
Persons attending a wedding or funeral
Those visiting an acquaintance who is ill.

In addition to the above, a Temporary Visitor Visa (to visit acquaintances/relatives) will be granted to those with special humanitarian considerations, those with a public interest, or other individual circumstances.

The documents required for a temporary visitor visa (to visit an acquaintance or relative) may vary from country to country, but the main documents to be prepared by the Japanese side are as follows

Letter of Reason for Invitation
Schedule of stay in Japan
Documents proving kinship: family register, birth certificate, etc.
Letter of Guarantee
One of the following documents related to the guarantor
A certificate of income　
A certificate of bank balance　
A copy of tax return　
Certificate of tax payment
Certificate of residence
A copy of family register (if married)

Since the documents to be prepared vary depending on the circumstances of the applicant, we strongly recommend that you consult with a specialist such as an administrative scrivener.
